The Council supports accrual and limitations of actions or claims as contained in RCW 4.16. The need to retain the commercially reasonable period to discover claims of six years and to have this same period apply equally to all construction claims is recognized as reasonable without discouraging investment and development. This period reduces the likelihood that some intervening negligence or destructive force has occurred to cause the damage.

The Council encourages practice which provides prompt inspection and proper maintenance to assure that claims will be discovered and made before witnesses have died, evidence is lost, or memories have faded.
