Federal RegulationsLike state and national associations across the country, AIA Washington Council is following activity in Washington D.C. regarding the Federal Communications Commissions’ (FCC) “do-not-fax” rules. These rules were promulgated earlier this year and would have required associations and other businesses to seek the express prior written consent of each recipient before transmitting any faxes considered “commercial” in nature. Through the American Society of Association Executives, (ASAE) such a hue and cry was raised that the FCC has reconsidered the effective date, moving it to January 1, 2005. ASAE is currently working the problem through both the executive and the legislative branches of the federal government. ASAE is preparing a letter urging the Office of Management and Budget (OMB) not to approve the FCC’s do-no-fax rules on the grounds that the FCC’s time and expense estimates to comply with the Consent requirement, as well as their definition of “established business relationship” are grossly inaccurate. On the legislative front, ASAE is continuing to brief Congressional leaders on the details of the issue and its importance to the association community.
